Terms & Conditions

1. Retainer

1.1. Retainer Fee: A non-refundable retainer fee of $150 is required to secure your session with Flori Photography. This fee will be deducted from the total package price and serves to reserve the agreed-upon date and time. Once the contract takes effect, Flori Photography will reserve this date exclusively for you, declining all other potential bookings.

1.2. Cancellation: Should you choose to cancel the booking for any reason, all payments made up to that point, including the retainer, will be retained by Flori Photography as compensation for loss of business. This policy reflects the costs incurred by blocking the date and the administrative work involved.

1.3. Included Services: The session fee covers the photographer's time and experience, along with basic retouching and creative editing of the images, as determined by Flori Photography. The photographer will select the final images for editing and inclusion in the gallery.

1.4. Image Gallery: High-resolution digital files will be provided through an online gallery, available for up to two weeks after delivery. A $50 fee applies if the gallery needs to be reloaded after this period. Flori Photography will retain images for three months post-session, after which it is no longer the photographer's responsibility to maintain the gallery.

2. Final Payment

2.1. Payment Terms: The remaining balance of your session fee is due 72 hours prior to the scheduled shoot. Please note that the deposit fee is non-refundable.

3. Rescheduling

3.1. Rescheduling Policy: In the event that you need to reschedule your session, the retainer fee will be retained to offset the loss of business from holding the date. Clients are permitted to reschedule with at least 48 hours' notice.

4. Client Wardrobe

4.1. Wardrobe Availability: Flori Photography offers a curated client wardrobe, available for use during your session. This wardrobe features a selection of clothing in various sizes and styles, chosen to complement the aesthetic of your session.

4.2. Wardrobe Use: Clients are welcome to choose outfits from the client wardrobe to wear during their session. It is recommended to discuss your wardrobe choices with the photographer prior to the session to ensure a cohesive look.

4.3. Care and Responsibility: Clients are expected to handle all wardrobe items with care. Any damage to clothing or accessories from the client wardrobe during the session will be the responsibility of the client. If a wardrobe item is damaged or lost, the client may be required to cover the cost of repair or replacement.

4.4. Personal Wardrobe: Clients may also choose to wear their own clothing for the session. It is encouraged to bring multiple options to allow flexibility during the shoot. Flori Photography can provide styling guidance to help you select outfits that will photograph beautifully.

5. Model Release

5.1. Consent for Use of Images: By participating in a session with Flori Photography, you grant the photographer the absolute and irrevocable right to use the photographs taken of you. This includes the right to copyright the images in the photographer’s name or any other name they may choose, as well as the right to use, re-use, publish, and re-publish the images in any medium, for any purpose, including but not limited to illustration, promotion, advertising, and trade.

5.2. Release of Claims: You hereby release and discharge Flori Photography from all claims and demands associated with the use of these photographs, including any claims for libel or invasion of privacy.

5.3. Ownership and Copyright:

All photographs and images produced by Flori Photography are and shall remain the intellectual property of Flori Photography. The photographer retains all rights to the images, including but not limited to, the right to copyright, sell, or publish them.

6. Liability and Damages

6.1. Client Responsibility: Flori Photography is not responsible for any injuries sustained by clients or any participating parties during sessions, whether on location or on the photographer’s property. Clients are fully responsible for themselves and their children, and by participating, you release Flori Photography from any claims related to personal injury or property damage.

6.2. Damage to Property: Clients are responsible for any damage to the photographer’s property or equipment, whether caused intentionally or accidentally. Once portraits are delivered to the client, Flori Photography is not responsible for any damage that may occur, including damage during transit by Australia Post or other couriers. Clients assume full responsibility for the safety of all portraits upon receipt.

7. Session Requests

7.1. Punctuality: Sessions will start at the agreed-upon time. Any time lost due to the client’s late arrival will be deducted from the session duration. If the client misses the entire session time, the full session fee will still be required.
